Terms and data processing agreement

1. Who we are

champaign SMS is operated by OLIP MARKETING - FZCO, license no. 92954, Dubai, UAE. Below, we refer to ourselves as “we”. You, the person who creates an account and sends messages, are referred to as “you”.

Messages are sent through CPSMS (Compaya A/S), our subcontractor.

2. What the service does

You log in with your mobile number, add phone numbers to groups and send a text message to them. The message is sent from your own mobile number, not from us. The recipient sees your number and can reply directly to you.

You pay per message, and you pay in advance by buying a code. Neither the code nor unused messages expire. We may change prices going forward, but never for messages you have already bought.

3. Your responsibility for recipients

Under § 10 of the Danish Marketing Practices Act, you may only send marketing to someone who:

• has expressly said yes, or
• is already your customer, where you obtained the number in connection with a sale, the message concerns something similar, and they were given the opportunity to opt out both at that time and in every message.

You may not send a text message to ask for consent. The request itself is marketing and is therefore also prohibited.

When you send, you declare for each send-out that the recipients meet the above. We store that declaration, with a timestamp, together with the basis you have entered for the group yourself.

If we receive a complaint, or have reason to believe the rules have not been followed, we may block your account immediately. Fines and claims arising from your send-outs are yours.

4. Data processing agreement

This section is the agreement between us required by Article 28 GDPR. It applies automatically when you accept the terms.

What we process

Phone numbers and any names you add, the consent basis you state yourself, the content of the messages and delivery status.

What we do — and don't do

• We only process data on your instructions, i.e. to send the messages you ask us to send.
• We never resell numbers and do not use them for our own marketing.
• We do not use your lists to enrich other customers' lists.
• Access is limited to the people at our company who need it.

Security

Data is encrypted in transit (TLS) and stored with Cloudflare in the EU. Login uses a one-time code sent by text message; we store no passwords for your account.

Deletion

You can delete a group or your account at any time. If you delete your account, we remove your lists within 30 days. We keep log data for sent messages for 12 months, because we must be able to document a send-out if a complaint is made.

Opt-outs

Every message contains an opt-out line. If a recipient opts out, the number is blocked for you automatically and cannot be added again. This is part of the service and cannot be switched off.

Breaches

If we discover a security breach affecting your data, we will notify you without undue delay and no later than 48 hours after becoming aware of it.

5. Payment

You buy a code. The code is the product: it contains a set number of messages and is shown on the receipt once payment is complete. The code requires no account, and you can pass it on — whoever redeems the code gets the messages added to their account. A code can only be redeemed once.

When you buy, you confirm that your details on country, company and VAT number are correct, that you are buying as a business, and that you are responsible for correctly accounting for tax in your own country. If you state the wrong country or VAT number, any subsequent claim is yours. The price shown is the final price — nothing is added at payment and there is no VAT, as champaign is run by a company in the United Arab Emirates. If you buy as a business, you are responsible for any tax in your own country. Payment is made through Stripe; we store no card details.

A code is the supply of digital content made available immediately. There is therefore no right of withdrawal for a code that has been redeemed, or for messages that have been used. If the code has not been redeemed, we will refund it within 14 days — write to us with the code.

6. When something goes wrong

We cannot guarantee that every single message is delivered — that depends on the mobile network operators. If a message is rejected by the gateway, you do not pay for it.

In all cases, our liability is limited to the amount you have paid us in the past 12 months. We are not liable for lost revenue or other indirect losses.

7. Changes and termination

You can close your account at any time. If we change these terms materially, you will be notified, and you must accept the new terms before you can send again.

8. Governing law

The laws of the Emirate of Dubai and the United Arab Emirates. The courts of Dubai have jurisdiction. If you are a consumer resident in the EU or EEA, you retain the protection afforded by the mandatory rules of your country of residence. In the event of any discrepancy between the language versions, the English version prevails.
